Gambling Enterprises Urged to Pay Taxes by the Cambodian Tax Agency

The General Department of Taxation (GDT) of the Ministry of Economy and Finance (MEF), Cambodia’s tax administration, is advising owners of commercial gaming firms to pay their taxes on time. The statement forewarns readers that the government may take legal action against them if they refuse to pay their taxes.

Aun Pornmoniroth, the finance minister of Cambodia, gave the go-ahead last Wednesday for new tax incentives and a clarification that owners of commercial gambling businesses who appear to file tax returns and pay taxes on a voluntary basis for their non-commercial gambling transactions will not face fines or penalties (such as additional tax charges and interest for late payments).

However, these incentives were only offered in instances of errors in tax return filing and payment, and their approval was only effective from the day the statement of notice was signed and issued through the end of the following month.

Kong Vibol, the director general of GDT, signed the statement on Thursday, one day after the incentives were given the go-ahead by the finance minister.

Khun Darith, the managing partner of K Professional Accountants (KPA), an auditing firm, is quoted in Khmer Times as saying that the GDT now mandates that they have to file for non-commercial gambling transactions on a voluntary basis with incentives, noting that the move is advantageous for both the government and the operators who might otherwise be subject to fines or penalties.

Non-commercial gaming transactions may include income from lodging establishments, dining establishments, spas, karaoke bars, markets, space rentals, and gift stores.

According to Khun Darith, “It is a very good strategy to raise more tax revenue because even though they would not be fined or penalized, they would pay taxes for their prior these non-gambling transactions and after they start doing so, they would continue and the government would raise more revenue in the future.”
